These Terms of Service ("Terms") govern your access to and use of fusionaiconsulting.com (the "Site") and any free tools, content, forms, and resources we make available through it, including our AI-Powered Ops Audit Scorecard (collectively, the "Services"). The Site and Services are operated by Fusion AI Consulting LLC ("Fusion AI Consulting," "we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Who May Use the Site

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements and that any information you provide is accurate and current.

2. Relationship to Paid Services

The Site provides general information about our services and free tools such as our scorecard. The Site itself does not deliver our paid consulting, audit, systems buildout, or retainer services.

Any paid engagement with Fusion AI Consulting is governed by a separate written agreement (such as a proposal, statement of work, or client service agreement) signed by you and us. Those separate agreements control the scope, fees, deliverables, timelines, and terms of the paid work. If anything in a signed service agreement conflicts with these Terms, the signed service agreement controls for that engagement.

Nothing on the Site is an offer to enter into a paid engagement, and submitting a form or completing the scorecard does not create a client relationship.

3. The Scorecard and Free Tools

Our AI-Powered Ops Audit Scorecard and any other free tools, assessments, checklists, or resources are provided for general informational and educational purposes only.

Scorecard results, scores, and recommendations are automated estimates based on the information you provide. They are general guidance, not a guarantee of any outcome, and not a substitute for a professional assessment of your specific business.

You are responsible for any decisions you make based on the results.

We may change, limit, or discontinue any free tool at any time without notice.

4. No Professional Advice

Content on the Site — including articles, frameworks, scorecard output, emails, and other materials — is provided for general informational purposes. It does not constitute legal, financial, tax, accounting, or other professional advice, and it does not account for your specific circumstances. You should consult a qualified professional before acting on any information from the Site.

5. Acceptable Use

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms

Submit false, misleading, or fraudulent information

Interfere with or disrupt the Site, its servers, or its security features

Attempt to gain unauthorized access to any part of the Site or its systems

Use automated means (bots, scrapers, crawlers) to access or collect data from the Site without our written permission

Copy, reproduce, resell, or exploit any part of the Site or Services except as expressly permitted

Use the Site or any content from it to develop, train, or improve a competing product, tool, or service

6. Intellectual Property

The Site and its content — including text, graphics, logos, frameworks, methodologies, scorecard logic, tools, and software — are owned by or licensed to Fusion AI Consulting LLC and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own internal, non-commercial informational purposes. All rights not expressly granted are reserved.

You may not use our name, logo, or trademarks without our prior written consent.

7. Communications Consent

By submitting your information through the Site, you consent to receive communications from us as described in our Privacy Policy, including emails and, where you provide your phone number and opt in, text messages. You can opt out of marketing emails using the unsubscribe link in any email, and out of SMS by replying STOP. Message and data rates may apply to SMS.

8. Third-Party Links and Services

The Site may contain links to third-party websites or use third-party platforms (such as our scheduling, CRM, and marketing tools). We are not responsible for the content, products, or practices of third parties. Your use of third-party sites and services is governed by their own terms and policies.

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FUSION AI CONSULTING LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR FREE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Liability for paid engagements is governed by the applicable signed service agreement.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Fusion AI Consulting LLC and its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

12. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the revised Terms on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
